A JUDICIALIZAÇÃO DA QUESTÃO AGRÁRIA QUILOMBO BOA VIDA MATA CAVALO
Analisamos aqui o processo de
legalização das terras do Quilombo Boa
Vida Mato Cavalo, apontando a insegurança
jurídica destas populações diante das decisões
interlocutórias e recorríveis já proferidas, que
dificultam o direito de posse. Iniciamos o relato
discorrendo sobre o histórico do Quilombo,
além de conceituar a questão agrária e a função
social da terra. Apontamos sobre o Poder
Judiciário e o processo de Judicialização em si.
Os dados foram coletados por meio de pesquisa
bibliográfica e documental, especialmente
sobre o Decreto 4.887/2003, a Ação Direta
de Inconstitucionalidade (ADIN) nº 3239, e o
Plano de Execução de Mandados Judiciais de
Reintegração de Posse Coletiva

Abstract:
We analyze here the process of legalization of the Quilombo Boa Vida
Mato Cavalo lands, pointing out the legal
insecurity of these populations in the face of
the interlocutory and resolutory decisions that
have already been handed down, which hinder
the right of possession. We started the report
by discussing the history of Quilombo, as well
as conceptualizing the agrarian question and
the social function of the land. We point to the
Judiciary and the Judiciary process itself. The
data were collected through bibliographic and
documentary research, especially on Decree
4,887 / 2003, Direct Action on Unconstitutionality
(ADIN) No. 3239, and the Plan for Execution
of Judicial Orders for Reinsertion of Collective
Ownership.
