PUNINDO A DESINFORMAÇÃO: Uma Análise sobre a Criminalização das Fake News por meio do estudo do Bem Jurídico-Penal

A presente pesquisa tem dois grandes objetivos gerais. O primeiro, é  realizar uma investigação da moldura jurídico-penal «ampla» construída para criminalizar as fake news, que já é utilizada em alguns países. O segundo, é analisar em como o estudo do bem jurídico-penal fará prova dessa moldura, ou seja, se há uma validação jurídica ou refutação desse modelo de punição. Para isto, percorrer-se-á alguns caminhos metodológicos. O primeiro passo de investigação é analisar o paradigma da pós-verdade, realizando um paralelo com a sociedade da (des) informação, posto que o fenômeno se põe de determinada forma a partir de uma crise da veracidade. É neste ponto que se trata da evolução da comunicação moderna, pela mídias digitais, pautadas em um aspecto rizomático, em detrimento da clássica formulação emissor-receptor. No segundo momento, faz-se uma análise comparada acerca dessa moldura penal ampla em países como França, Brasil e Singapura. A última parte do trabalho, a partir do conceito material de delito, reflete sobre a necessidade jurídica em punir (ou não) a desinformação, a partir das experiências legislativas já concretizadas pelos países em questão, fazendo prova dessa moldura pela teoria do bem jurídico. A hipótese da presente pesquisa é a da validade da construção de uma moldura jurídico-penal alternativa para as fake news, centrada não no ato da (re)produção da notícia falsa, mas no seu financiamento.

  • Abstract:

    This research has two main general aims. The first one is to investigate the «broad» legal-criminal framework built to criminalize fake news and already used in some countries. The second aim is to analyse how the study of the legal-criminal good will prove this framework, that is, if there is a legal validation or refutation of this punishment model. For this, some methodological paths will be covered. The first step in this investigation is to analyse the post-truth paradigm, making a parallel with the (dis) information society, since the phenomenon arises in a certain way from a crisis of veracity. It is at this point that the evolution of modern communication, through digital media, is based on a rhizomatic aspect, to the detriment of the classic emitter-receiver formulation. In the second moment, a comparative analysis is made about this broad penal framework in countries like France, Brazil, and Singapore. The last part of the work, based on the material concept of crime, reflects the legal need to punish (or not) disinformation, based on the legislative experiences already implemented by the countries in question, proving this framework through the theory of the legal good. The hypothesis of this research is the validity of the construction of an alternative legal-penal framework, centred not on the act of (re)producing fake news, but on its financing.
