FILOSOFIA E PENSAMENTO JURÍDICO: UM BREVE ESTUDO
Este artigo tem como objetivo analisar e refletir sobre a filosofia e sua aplicação no campo jurídico, na interpretação dos princípios e nos ideais de justiça. O Direito é a ciência do dever ser: onde está o homem está o Direito. Onde está o Direito, está a Filosofia. Destacamos nessa pesquisa o pensamento de filósofos juristas e o pensamento de juristas filósofos através dos tempos. Desse olhar para a filosofia e para o direito, percebemos como essas duas áreas dialogam. Realizamos uma pesquisa bibliográfica a partir dos autores CLÓVIS (1897), MACHADO NETO, entre outros, buscando relacionar a presença da filosofia no direito e sua importância como ciência que conduz a reflexões e análises à luz da crítica. Conclui-se ser a Filosofia parte do direito, na hermenêutica e nos processos interpretativos e de conciliação através do diálogo. Confúcio, em sua máxima, ao responder ao discípulo quando lhe indaga se devia pagar o mal com o bem, teria respondido: “Com que então recompensarás a bondade”? Pagarás o bem com o bem e o mal com a justiça. É dessa concepção de Confúcio que buscamos abordar nesse trabalho a filosofia em conexão com o pensamento jurídico.

Abstract:
This article aims to analyze and reflect on philosophy and its application in the legal field, in the interpretation of the principles and ideals of justice. The Law is the science of the duty to be: where the man is the Law. Where the Law is, there is Philosophy. We highlight in this research the thought of legal philosophers and the thought of legal philosophers through the ages. From this look at philosophy and law, we see how these two areas dialogue. We carried out a bibliographic research from the authors CLÓVIS (1897), MACHADO NETO, among others, seeking to relate the presence of philosophy in law and its importance as a science that leads to reflections and analyzes in the light of criticism. It is concluded that Philosophy is part of the law, in hermeneutics and in the interpretative and conciliation processes through dialogue. Confucius, in his maxim, when he answered the disciple when he asked him if he should pay evil with good, would he have replied: "With what then will you reward kindness"? You will pay good with good and evil with justice. It is from this conception of Confucius that we seek to approach philosophy in connection with legal thinking in this work.
