Trata-se de artigo elaborado como uma revisitação ao tema de nossa dissertação do mestrado em Direito, concluído em 2015, pela Universidade Presidente Antônio Carlos, Juiz de Fora - MG. Verifica-se, que o Direito Fundamental à Informação continua sendo instrumento de grande importância no desenvolvimento do Estado brasileiro como ferramenta valiosa de fortalecimento da Democracia e emancipação da Cidadania. Utilizar-se-á como metodologia para o desenvolvimento do presente estudo a pesquisa qualitativa, realizando-se levantamento bibliográfico. O estudo será organizado em quatro capítulos, quais sejam, (i) Aspectos legais do acesso à informação, (ii) Aspectos gerais e específicos da conceituação de Democracia, (iii) Aspectos gerais e específicos da cidadania, que concatenados de forma lógica e racional levarão o leitor à conclusão de que o controle social da administração pública fundamentado na Constituição e em legislações infraconstitucionais é instrumento valioso ao melhoramento civilizatório do país.

  • Abstract:

    This is an article prepared as a revisit to the theme of our Master's in Law dissertation, concluded in 2015, by the President Antonio Carlos University, Juiz de Fora - MG. It appears that the Fundamental Right to Information remains an instrument of great importance in the development of the Brazilian State as a valuable tool for strengthening Democracy and emancipating Citizenship. Qualitative research will be used as methodology for the development of this study, with a bibliographic survey. The study will be organized in four chapters, namely, (i) Legal aspects of access to information, (ii) General and specific aspects of the concept of Democracy, (iii) General and specific aspects of citizenship, which are concatenated in a logical and rational way will lead the reader to the conclusion that the social control of public administration based on the Constitution and on infra-constitutional legislation is a valuable instrument for the country's civilization improvement.
