A CONSTRUÇÃO DA LEI Nº 9.394/96: TRAJETÓRIA E IMPASSES POLÍTICOS
A promulgação da mais nova Lei
de Diretrizes e Bases da Educação Nacional,
em dezembro de 1996, acabou por frustrar,
de maneira geral, a todos os educadores que
defendiam de forma veemente a educação
pública e gratuita à população. Entender os
motivos que levaram a concepção do texto tal
como se apresenta na lei, requer fazer uma
retrospectiva e análise do momento histórico do
país, assim como pontuar impasses políticos
ocorridos durante tramitação da mesma no
Parlamento brasileiro. O presente trabalho,
construído por meio de pesquisa bibliográfica e
documental, apresenta a trajetória da construção/
elaboração da Lei nº 9394/96 (Lei Diretrizes e
Bases da Educação Nacional), desde o início
das mobilizações dos educadores defensores
da escola pública, em busca da elaboração
de uma lei que garantisse a gratuidade da
educação, passando pela redemocratização do
Brasil, mais especificamente com a instauração
do Congresso Constituinte em 1988, até sua
promulgação em 20 de dezembro de 1996, pelo
então presidente Fernando Henrique Cardoso.
A pesquisa tem como objetivo geral explanar
o momento histórico e os impasses políticos
ocorridos no período de tramitação da nova LDB
no parlamento brasileiro, motivos que levaram
o texto final se adequar à nova concepção de
Estado mínimo marcadamente neoliberal. Para
além disso, a presente pesquisa tem o intuito de
elucidar as intervenções, por parte das forças
conservadoras no Parlamento, em vista de
eivar o Projeto de lei da educação nacional com
artigos que beneficiassem a iniciativa privada
em educação, transformando o texto final em
um dispositivo de garantia para sustentação de
seus interesses.

Abstract:
In December 1996 the newest
Law of Directrices and Bases of Education (Lei
de Diretrizes e Bases da Educação Nacional,
in Portuguese) was promulgated and it had
frustrated mainly all the educators who passionately defended the public and free
education for all Brazilian population. Understanding the reasons which drove to the
final text as it can be found on the Law demands to analyse the country retrospective
and historical context as well as to point out political impasses along the law process
in Brazilian Parliament. The present paper, built on a bibliographical and documental
research, presents the trajectory to the construction/elaboration of Law #9394/96
(Law of Directrices and Bases of Education – Lei de Diretrizes e Bases da Educação
Nacional also LDB, in Portuguese) since the beginning of educators mobilizations who
defended public education, searching the elaboration of such a law that could warrant
education gratuity, passing through Brazilian re-democratization, more specifically with
the establishment of the Constitutional Congress in 1988 until its enactment on 20th
December 1996, by Brazilian president Fernando Henrique Cardoso. The research
aims to explore the historical context and the political impasses along the enacting
process to the new LDB in Brazilian Parliament, and also the motivations that drove the
final text to be adapted to the new conception of the neoliberal Minimum State. Besides,
this research also aims to elucidate the interventions by the conservative strengths
in such Parliament, which intended to flaw the law project of national education with
articles that could profit the education private initiative transforming the final text in a
warranty to keep their interests and privilege.
