ENERGIA FOTOVOLTAICA CENTRALIZADA NO BRASIL: UMA ANÁLISE DA LEGISLAÇÃO AMBIENTAL
Entre as vantagens da energia
gerada a partir da fonte solar podemos citar o
fato dela ser renovável, possuir baixa emissão
de gases de efeito estufa durante a operação e
ser complementar com relação a outras fontes.
Apesar disso, gera impactos e, de acordo com
a CONAMA, é considerada uma atividade
modificadora do meio ambiente quando maior
que 10 MW e sujeita a procedimentos para o
licenciamento ambiental (BRASIL, 1986). Para
participar de leilões para expansão da oferta de
energia elétrica, o empreendedor responsável
pela usina fotovoltaica deve apresentar à
Empresa de Pesquisa Energética uma licença
ambiental válida e os estudos de impacto
ambiental. Ainda não existe regulamentação
no nível federal para o licenciamento ambiental
de usinas fotovoltaicas, mas alguns órgãos
estaduais de meio ambiente estabelecem
procedimentos para a emissão de licença
ambiental. Nesse sentido, foi feita uma análise
da regulamentação do licenciamento ambiental
das usinas fotovoltaicas praticada por alguns
órgãos ambientais e verificou-se que, dos 10
órgãos analisados, dois não possuem base legal
específica. Quanto aos órgãos que a possuem,
os critérios utilizados para o enquadramento
do projeto e o tipo de estudo solicitado para
apresentação junto ao órgão estadual de meio
ambiente são variados.

Abstract:
Among the advantages of the
energy generated from the solar source we can
mention the fact that it’s a renewable source,
has a low emission of greenhouse gases and is
complementary with respect to other sources.
Despite this, it generates impacts and, according
to the CONAMA, is considered an environmentmodifying activity when greater than 10 MW
and subject to procedures for environmental
licensing. To participate in an auction of energy
from solar plants, the entrepreneur must
submit to Empresa de Pesquisa Energética the Environmental License and the environmental impact studies. There isn´t yet any
regulation on federal level for the environmental licensing of photovoltaic plants, but
some state environmental agencies establish procedures for issuing an environmental
license. In this sense, it was made an analysis of the regulation of environmental
licensing of solar energy projects by the environmental agencies of the states where
this type of venture was already contracted through auctions and it was verified that, in
10 analyzed organs, two don´t have specific legal basis. In reference of the agencies
that have this specific legal basis, the criteria used for the project framework and the
type of study requested for submission to the state environmental agency are varied.
