O ENSINO DO DIREITO PARA OS INDÍGENAS
O ensino do direito para os indígenas é previsto na Convenção 169 da Organização Internacional do Trabalho-OIT e tem orientação do Ministério da Educação, através do Referencial Curricular Nacional para as Escolas Indígenas-RCNEI, para ser ensinado dentro das escolas indígenas. No entanto, como muitos dos direitos previstos na legislação brasileira, sua efetivação não é plena. Isto se dá, porque a eficácia social dos direitos é influenciada pela orientação político-jurídica do Estado; pela aplicação geral da lei, sem considerar os grupos diferenciados dentro do Estado (como é o caso dos indígenas); e, pelo modelo econômico predominante. Para desenvolver este tema destacam-se os direitos que mais impactam na organização social indígena: os direitos relativos à educação para indígenas, entre elas o ensino do direito; e por fim uma análise crítica quanto ao ensino do direito aos indígenas e à efetividade dos direitos que lhes são assegurados.

Abstract:
The teaching of the law for indigenous people is provided for in Convention 169 of the International Labor Organization-ILO and is guided by the Ministry of Education, through the National Curriculum Framework for Indigenous Schools-RCNEI, to be taught within indigenous schools. But, like many of the rights foreseen in the Brazilian legislation, its effectiveness is not complete. This is because the social effectiveness of rights is influenced by the political-legal orientation of the State; by the general application of the law, without considering the differentiated groups within the State (as is the case of the Indians); and by the predominant economic model. To develop the theme, the rights that most impact indigenous social organization are highlighted; rights relating to indigenous education, including the teaching of law; and finally a critical analysis regarding the teaching of the right to indigenous peoples and the effectiveness of the rights that are guaranteed to them.
