O USO DA TECNOLOGIA DA INFORMAÇÃO E COMUNICAÇÃO NO PROCESSO DE ENSINO E APRENDIZAGEM: A VIOLAÇÃO DOS DIREITOS DA PERSONALIDADE FRENTE À CAPTAÇÃO E DIVULGAÇÃO DE IMAGENS DE PACIENTES
O presente trabalho versa sobre o
surgimento da Internet e o desenvolvimento
das Tecnologias da Infomação e Comunicação,
sobre a maneira como a sociedade se tranforma,
passando a compartilhar suas experiências na
Rede sob o enfoque da violação dos direitos da
personalidade frente à captação e divulgação
de imagens de pacientes. Para tanto, destacase
a importância da observação dos direitos
da personalidade mesmo em tempos de novas
tecnologias. A partir de tal enfrentamento,
busca-se compreender o direito à imagem,
sendo um importante direito personalíssimo,
sua limitação, de que modo pode ser vivenciado
nesse contexto. Dessa forma, reflete-se de que
modo as imagens vêm sendo reproduzidas,
uma vez que para a captação o consentimento
do indivíduo é imprescindivel. Ainda, ao que
pese aos ambientes hospitalares, sejam de
aprendizagem, ou de prática médica, o presente
estudo, quer verificar se as condutas dos
aspirantes e dos já consagrados profissionais
da saúde respeitam o direito à imagem, que
é inerente a cada um de seus pacientes, bem
como, se o Código de ética médica vem sendo
devidamente respeitado. Para o estudo, utilizouse
o método dedutivo.

Abstract:
This paper aims at discussing
the rise of the Internet and the development of
Infomation and Communication Technologies,
the way society has been changing, with
its citizens sharing their experiences in the
network, concerning the violation of personal
rights in relation to capturing and releasing
images of patients. The importance of taking
into consideration the personal rights, even
in times of new technologies, is highlighted.
Furthermore, it aims to understand the right to
the image, as it is an important personal right, its
limitations and how it can be experienced in this
context. Thus, the way the images have been
reproduced is analyzed since the individual’s
consent to capture the image is indispensable.
This study also aims to verify whether the
manners of health professionals respect the
right to patients’ images, which is inherent to
everyone, and whether the Code of Medical Ethics has been fully observed. In order to
carry out this study, the deductive method was used.
