A INFLUÊNCIA DA ECONOMIA NO DIREITO: INCERTEZAS CIENTIFICAS E O PRINCIPIO DA PRECAUÇÃO
O objetivo do artigo é analisar
as influências da economia ambiental e da
economia ecológica no direito, no sentido de
sensibilizar o direito a desenvolver institutos
que busquem mitigar os riscos inerentes às
incertezas científicas. Desse modo, o corte
epistemológico restringe a análise às correntes
do pensamento econômico – economia
ecológica e economia ambiental e no campo
jurídico, à formação do princípio da precaução
como instrumento atenuante das incertezas
científicas. Ao empreender uma revisão
hermenêutica de obras especializadas, foi
possível, com os resultados obtidos, contribuir
para o aprofundamento e o esclarecimento
do modus operandi dos diferentes campos
pesquisados – econômico e jurídico, em face
à promoção do desenvolvimento sustentável. E
a título de conclusão, destaca-se a modelagem
do direito como resultado das influências do
campo econômico, ao desenvolver o princípio
da precaução que busca gerenciar e, no limite,
eliminar, os riscos provenientes das incertezas
científicas.

Abstract:
The objective of this article
is analize the enviromental economics and
ecological economics to the law, to promote
awareness of the law to develop institutions that
seek to mitigate the risks inherent to scientific
uncertainties. Thus, the epistemological break
restricts the analysis to current economic thinking
- the ecological economy and environmental
economy - and in the legal field, the formation
of the precautionary principle as a mitigating
tool to scientific uncertainties. To undertake a
bibliographical review of specialized works, it was
possible, with the results obtained, to contribute
to the deepening and the clearing of the modus
operandi from the different fields surveyed, due
to the promotion of sustainable development.
To conclude, it is highlighted the sensitivity of
law to the influences of the economic field in
order to develop the precautionary principle in
the search for diminishing the risks from the
scientific uncertainties.
